108. Qualifications of counsel. - (1) Neither the prosecutor nor the accused has any right to object to any counsel if properly qualified. (2) A counsel shall be deemed to be properly qualified if he is a legal practioner authorized to practise with right of audience in a Court of Sessions in India, or if he is recognised by the convening officer in any other country where the trial is held as having in that country rights and duties similar to those of such a legal practitioner in India and as being subject to punishment or disability for a breach of professional rules.
