8. Disqualifications for trusteeship or membership of Regional Committee.- (1) A person shall be disqualified for being appointed as, or for being a trustee or member of a Regional Committee:— (i) if he is declared to be of unsound mind by a competent court; or (ii) if he is an undischarged insolvent; or (iii) if before or after the commencement of the Act he has been convicted of an offence involving moral turpitude; or (iv) if he as an employer in relation to an exempted establishment or an establishment to which the Scheme applies has defaulted in the payment of any dues to the Central Board or the Fund recoverable from him under the Act or the Scheme, as the case may be. (2) If any question arises whether any person is disqualified under sub-paragraph (1), it shall be referred to the Central Government and the decision of the Central Government on any such question shall be final. |
