Before punishing employer for the misconduct committed by him, the employer is required to follow the principle of natural justice i.e. the opportunity of hearing to the employee and defend the allegation labeled against him. Thus in order to justify an action against the employer for his misconduct the employer has to -Issue show cause notice -Issue a charge sheet -Appoint an enquiry officer to conduct the enquiry proceeding. -In Enquiry proceeding a reasonable opportunity to the employer to defend the allegation labeled against him -Issue order of punishment. |
